Terms of Service

1. Acceptance of Terms
By accessing or using CafeWork ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.
CafeWork is operated by CafeWork B.V., a company registered in the Netherlands. These Terms constitute a legally binding agreement between you and CafeWork.
2. Description of Service
CafeWork is a platform connecting remote workers with cafes and workspaces for flexible, on-demand coworking. The Service includes:
- Discovery and booking of workspace seats at partner cafes
- QR code-based check-in and checkout system
- Credit-based payment system and wallet management
- Loyalty rewards and community features
- Partner dashboard for cafe owners to manage listings and bookings
3. User Accounts
3.1 Registration
To use the Service, you must:
- Be at least 16 years old
- Provide accurate, current, and complete information
- Maintain and update your information to keep it accurate
- Maintain the security of your account credentials
- Accept responsibility for all activities under your account
3.2 Account Security
You are responsible for maintaining the confidentiality of your password and account. Notify us immediately of any unauthorized use or security breach.
4. Bookings and Payments
4.1 Credits System
The Service operates on a prepaid credit system:
- Credits are purchased in advance and stored in your wallet
- Credits are deducted automatically based on session duration
- Minimum charge per session: €0.50
- Credit purchases are processed securely via Stripe
- Credits do not expire while your account is active
4.2 Pricing
Pricing varies by cafe and is displayed before booking. Partners set their own rates (minimum €1.20/hour). All prices include VAT.
4.3 Refunds
Wallet balance refunds are subject to:
- 7-day holding period for chargeback protection
- Processing time of 5-10 business days
- Refunds issued to original payment method
- No active sessions at time of refund request
4.4 Cancellations
You may end a session at any time. You will only be charged for actual time used (minimum €0.50 per session applies).
5. User Conduct
When using the Service, you agree NOT to:
- Violate any laws or regulations
- Infringe on intellectual property rights
- Harass, abuse, or harm other users or cafe staff
- Share false or misleading information
- Attempt to manipulate or game the loyalty system
- Reverse engineer or tamper with the Service
- Use automated systems to access the Service without permission
- Share your account credentials with others
6. Partner Terms
6.1 Partner Eligibility
To become a partner cafe, you must:
- Be a legitimate business with proper licenses
- Provide accurate information about your space and amenities
- Maintain appropriate workspace standards
- Comply with local health and safety regulations
6.2 Commission Structure
Partners pay 15% commission on each booking:
- Partners receive 85% of booking revenue
- No setup fees or monthly subscriptions
- Payouts processed weekly to partner bank accounts
- Detailed earnings reports available in partner dashboard
6.3 Partner Obligations
As a partner, you agree to:
- Honor all bookings made through the platform
- Maintain accurate availability and pricing
- Provide a clean, safe workspace environment
- Treat CafeWork users with respect and professionalism
- Notify us promptly of any issues or changes
7. Intellectual Property
All content, features, and functionality of the Service are owned by CafeWork and protected by copyright, trademark, and other intellectual property laws.
You may not copy, modify, distribute, sell, or lease any part of our Service without explicit written permission.
8. Liability and Warranties
8.1 Service "As Is"
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied.
8.2 Limitation of Liability
To the maximum extent permitted by law, CafeWork shall not be liable for:
- Indirect, incidental, or consequential damages
- Loss of profits, data, or business opportunities
- Actions or omissions of partner cafes
- Issues beyond our reasonable control (force majeure)
8.3 Partner Liability
Partner cafes are independent businesses. CafeWork is not responsible for the quality, safety, or legality of partner spaces. Any issues with a partner cafe should be reported to us immediately.
9. Termination
9.1 By You
You may delete your account at any time from account settings. Upon deletion:
- Your wallet balance must be zero (request refund first if needed)
- All active bookings will be canceled
- Personal data will be anonymized within 30 days
- Financial records retained for 7 years (legal requirement)
9.2 By CafeWork
We may suspend or terminate your account if you:
- Violate these Terms
- Engage in fraudulent activity
- Abuse the Service or other users
- Provide false information
We will provide notice when possible, but reserve the right to terminate immediately for serious violations.
10. Dispute Resolution
10.1 Governing Law
These Terms are governed by the laws of the Netherlands, excluding conflict of law principles.
10.2 Disputes
For any disputes:
- First, contact us at support@cafework.nl to resolve informally
- If unresolved, disputes will be submitted to the competent court in Amsterdam, Netherlands
- Consumer disputes may be escalated to the European Online Dispute Resolution platform
11. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes via:
- Email notification to your registered address
- Prominent notice in the app or website
- In-app notification on your next login
Continued use of the Service after changes constitutes acceptance of the updated Terms.
12. Miscellaneous
12.1 Entire Agreement
These Terms, along with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and CafeWork.
12.2 Severability
If any provision is found unenforceable, the remaining provisions will continue in full effect.
12.3 No Waiver
Failure to enforce any right or provision does not constitute a waiver of that right.
